Terms & Conditions – Black and White
The Black and White application is owned and operated by DIGIVAST TECH SOLUTIONS PRIVATE LIMITED.
Welcome to Black and White (“App”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Black and White mobile application.
By downloading, registering, or using the App, you agree to be legally bound by these Terms.
1. Eligibility
- Strictly for users aged 18 years and above
- Underage accounts will be terminated immediately
2. Account Registration & Access
- Registration via valid mobile number
- OTP-based login
- Single active session per user
- User responsible for account security
3. Profile Verification & Anti-Scam Measures
- Facial feature detection during onboarding
- Fake or AI-generated profiles are prohibited
- Violation leads to suspension or permanent ban
4. User Conduct & Responsibilities
- No impersonation, harassment, or abuse
- No illegal or commercial usage
- No bypassing security or privacy features
5. Communication & Encryption
- Encrypted one-to-one communication
- Private and secure messaging
- No monitoring except where legally required
6. Content & Media Sharing Rules
6.1 Prohibited Content
- Pornographic or explicit public content
- Content involving minors
- Non-consensual intimate media
- Illegal or hateful material
6.2 Private Media & One-Time View
- One-time view media expires after viewing
- Absolute prevention of misuse cannot be guaranteed
7. Screenshot & Screen Recording Restrictions
Screenshots and screen recordings are disabled. Bypassing these restrictions may result in immediate account termination.
8. User Safety & Reporting
- Users may report abuse, scams, or fake profiles
- We may investigate and take action
9. Account Suspension & Termination
Accounts violating these Terms may be suspended or permanently terminated without notice.
10. Intellectual Property
All trademarks, content, and software belong to Black and White.
11. Disclaimer of Liability
Black and White is a platform provider only. User interactions are at your own risk.
12. Limitation of Liability
We are not liable for user-generated content, disputes, or unauthorized data sharing.
13. Data Usage & Privacy
Use of the App is governed by our Privacy Policy.
14. Compliance with Indian Laws
Governed by Indian law and IT regulations.
15. Modifications to Terms
Terms may be updated from time to time.
16. Governing Law & Jurisdiction
Courts located in Mumbai, Maharashtra, India shall have jurisdiction.
17. Accepted Payment Methods
For android users:
Payments for subscriptions and premium features on Black and White may be made using the following methods:
- Credit Cards / Debit Cards
- UPI (where applicable)
- Net Banking
All payments are securely processed through authorized third-party payment gateways. We do not store your card or banking details on our servers.
For apple users:
All in-app purchases and subscriptions are processed exclusively through Apple’s In-App Purchase system. Apple users cannot use external payment methods.
18. Pricing & Taxes
- All prices are displayed in INR unless otherwise stated.
- Applicable taxes (including GST) may be added as per government regulations.
- Final payable amount is shown before confirming payment.
19. Subscription Plans
Our app may offer weekly, monthly, quarterly, or annual subscription plans.
- Subscriptions are auto-renewable and will automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
- For Apple user's payment will be charged to your Apple ID account at confirmation of purchase.
- Apple users can manage or cancel their subscription at any time through their App Store account settings.
- Access to premium features continues until the end of the billing period.
- Apart from premium plans, user can buy add-ons (like superchat) can be bought along with ongoing premium plans.
Note: All payments and refunds for subscriptions purchased through the Apple App Store are handled by Apple. We do not have access to your billing information. Your account will be charged for renewal within 24 hours prior to the end of the current period.
20. Failed or Declined Payments
If a payment fails due to insufficient balance, expired card, or technical issues:
- Access to premium features may be temporarily suspended.
- You are responsible for maintaining valid payment information.
21. Price Changes
We reserve the right to change pricing at any time. Any changes will be communicated in advance and will apply only to future billing cycles.
22. Fraud Prevention
To maintain platform safety:
- Suspicious or fraudulent transactions may be blocked or reversed.
- Accounts involved in misuse or chargeback abuse may be suspended or permanently terminated.
- No refunds will be issued for accounts banned due to policy violations.
23. Refund & Cancellation Policy
All purchases are generally non-refundable. For purchases made via the Apple App Store, refund requests must be submitted directly to Apple and are subject to Apple’s refund policies. Except in cases explicitly stated in this policy eligibility criteria or required by applicable law.
By completing a purchase, you agree to this Refund & Cancellation Policy.
Refund Eligibility
Refunds are not guaranteed and are evaluated on a case-by-case basis.
A refund may be considered only under the following circumstances:
- The user was charged multiple times due to a technical error. For example, if the payment amount was deducted but the transaction did not complete successfully, and the user attempts the payment again resulting in multiple deductions. In such cases, the user must email the transaction details to the contact address mentioned under Contact & Grievance Redressal. After verification, the excess amount will be refunded.
- The app does not allow users to purchase multiple subscriptions for the same period; however, if due to a technical issue a user is able to purchase more than one subscription, the subscription with the shorter duration will be refunded.
- The service was unavailable for an extended period due to a verified technical issue.
- Payment deducted but not reflected in the app due to a technical glitch. Once reported via email and verified, the refund will be processed and credited to the user’s account within 72 hours.
Note: All refund-related communication must be sent through the official email address mentioned under Contact & Grievance Redressal. All eligible refunds are processed within 3–4 working days.
Refunds will not be issued for:
- Change of mind after purchase.
- Partial usage of subscription period.
- Account suspension due to policy violations.
- Inactivity or dissatisfaction with matches or user experience.
24. Content Moderation & User Safety
Our platform includes user-generated content such as profiles, text messages, and interactions. To maintain a safe environment, we moderate user activity through a combination of automated tools and human review. We reserve the right to review, filter, edit, block, or remove content that violates our guidelines, including but not limited to:
- Abusive or harassing messages
- Hate speech or discriminatory content
- Sexually explicit or inappropriate content
- Scams, fraud, impersonation
- Threats, violence, or illegal activity
- Spam or unwanted repetitive messages
24.1. Moderation Process - Automatic Filters
- Keyword scanning for abusive or explicit terms.
- Scanning using ML backed cloud system to uploaded media for explicit, violence and gore content. System restrict these content during upload.
- Auto flag profiles if been reported by specific number of users. Application admin notified of these flagged profiles.
24.2. Moderation Process - Human Moderation
- Team reviews flagged profiles and its content.
- Manual action within 24 hours of report. Profile once blocked can't be access until requested for review and no detection of violating application terms & conditions.
- High-risk cases escalated immediately.
24.3. Enforcement Actions
- Reported profiles are warned through mail and in severe cases through one to one calls.
- Remove violating content
- Suspend the account temporarily
- In severe cases - Permanently ban the user
We may retain logs of moderated content for safety, legal compliance, and fraud prevention. Only authorized team members can access this data.
25. Account Termination & Misuse
If your account is suspended or terminated due to:
- Violation of terms
- Misuse, harassment, or fake profiles
- Fraudulent activity
Then no refund will be issued, even for unused subscription periods.
